1. THE GYM

1.1 The Gym is managed by Titan Gym Limited, Unit 6 The Aercon Building, Woodside Road, Eastleigh, SO50 4ET

2. ACCEPTANCE OF MEMBERSHIP

2.1 The decision to accept the application of a potential member shall be at the sole discretion of the Gym. The gym reserves the right to verify, or require proof of all information given in order to obtain membership and any fraudulent or wrongful information given in order to obtain such membership could result in the cancellation of all membership rights and lead to the repayment of all monies due to the Gym. If the membership application is accepted by the Gym, membership of the Gym by the applicant shall commence as stated on the agreement. Upon acceptance of the member by the Gym, a membership card shall be issued by the Gym. The membership card remains the property of the Gym and entitles the holder to all the rights and privileges exercisable by the category of membership of the holder.

2.2 The acceptance of an application for membership of the Gym shall constitute a legally binding agreement between the member and the Gym. The member hereby agrees also to be bound by the Club Rules, a copy of which can be provided by asking at Reception.

2.3 Membership cards are issued to all current members and must be shown at Reception to gain membership rights every time a visit is made to the Gym. Membership cards may only be used by the registered member and any fraudulent use of the membership card by the member could result in cancellation of the membership with no refund being made by the Gym.

3. LIMITATION OF LIABILITY

3.1 The member acknowledges that the Gym’s obligations and liabilities in respect of the Gym are defined in this agreement and/or within the Regulations Applicable to All Users.
3.2 The member is responsible for the consequences of any use of any of the facilities of the Gym. The Gym will not be liable for any indirect or consequential loss, damage, costs, expenses, theft or damage to property, whether arising under contract, or otherwise.

4. PHYSICAL HEALTH OF MEMBER

4.1 The member warrants and also represents that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition.
4.2 Before using the Gym, the member must first complete a Gym Introduction pre-exercise questionnaire and unless otherwise agreed undergo an induction session.

5. MEMBERSHIP

5.1 The categories of membership are Single, Student and HM Services
All categories of membership shall be subject to these Terms and Conditions of Membership
which are in force at the time.
5.2 Other categories of membership shall be stipulated by the Gym from time to time.

6. MEMBERSHIP CHARGES & PAYMENT OPTIONS

6.1 All members are liable to pay all annual or monthly membership fees irrespective of actual usage of the Gym facilities.
6.2 Members may elect to pay their membership fees in monthly instalments (Direct Debit)or in full.
6.3 The Gym reserves the right to increase Membership fees on a yearly basis. If paying by
Direct Debit, the contract is for a minimum of 12 months (the period). Following the first period,

Titan gym will continue to take monthly Direct Debit/Stripe instalments unless written notice is received by the Gym at least 1 calendar month prior to proposed termination date.
6.5 If you lose your entrance keyfob there will be a £15 charge for a new one.

7. TERMINATION

7.1 Causes for termination.
The following reasons may be acceptable to The GYM subject to formal agreement.
Illness: with letter from GP or referring Doctor
Relocation: proof of new address required at least 15 miles from the gym
Bankruptcy
Imprisonment

8. EXPULSION OF MEMBERS OR TERMINATION OF MEMBERSHIP BY THE GYM

8.1 The Gym may expel members or may terminate the membership
of any member:
8.1.1 without notice and with immediate effect if the member’s conduct, whether or not such conduct is the subject of a complaint by another member or group of members, is such that in the reasonable opinion of the Gym, it may be injurious to the character, name or interests of the
Gym or is such that it renders the member unfit to associate with other members of the Gym.
8.1.2 By notice in writing if any part of the annual membership fee or monthly membership charge which is due and payable remains unpaid thirty days after the due date for payment.
8.2 Lapses in membership payment will incur an Administration charge.
8.3 A member whose membership is terminated by the Gym, shall forfeit all privileges of membership with immediate effect without an entitlement to any claim for any refund of their annual or monthly membership fee. On termination of their membership, the member shall return forthwith their membership card.

9. GYM FACILITIES

9.1 Certain categories of membership do not include all of the Gym’s services and facilities.
Services and facilities not so included may be provided at an additional charge at the Gym’s discretion.
9.2 Members who fail to attend pre-booked activities may be charged the full standard fee for the activity in question.
9.3 The Gym reserves the right to make reasonable alterations to the type of facilities provided without notice and the Gym shall not be liable for any inconvenience caused by building works and for the provision of essential maintenance services that occur for 14 days or less, due to matters beyond our control or improvement works.
9.4 Lockers are made available subject to availability. The Gym does not undertake that use of a locker will guarantee that no theft of or damage to your property will occur. We will not accept any liability in relation to locker thefts unless they result from our negligence. You should check that your household contents or other insurance policy protects you against any risk of theft.
9.5 Lockers may only be used for the purposes of keeping gym kit, toiletries, and the clothing that you were wearing when you came to the Club. The keeping of any other items in the Club’s lockers is prohibited. If the Gym has reasonable grounds to suspect that a locker is being used in breach of this Rule, the Gym reserves the right to open the locker in question (by force if necessary) and remove any offending items.
9.6 With the exception of any designated private lockers, lockers are available for use only while you are on the Club’s premises. Use of a locker (other than any designated private lockers) while not on Club premises is prohibited. If you leave your belongings overnight in a locker (other than in any designated private locker), the Gym reserves the right to open the locker (by force if necessary) and remove your belongings.

10. CAR PARKING

10.1 Our car park may only be used by Members, guests, and visitors while they are on the Gym premises. You may not leave your car in our car park at any other time (for example, you may not leave it there following a Gym visit while you go shopping elsewhere).
10.2 No unauthorised parking is permitted on the Gym premises. Where car parking spaces are designated for use by Members, cars must be parked properly in such spaces or they will be clamped and a fee may be charged (where applicable) for removal of the clamp.

11. HOURS OF OPENING

11.1 Information in relation to the Gym’s normal hours of operation and the opening hours of the facilities are available from the Gym upon request. Such hours may be lengthened or shortened at the absolute discretion of the Gym with or without any prior notice being given to members.
The Gym shall endeavour to give members reasonable notice of change to such hours.
11.2 On occasions when necessary maintenance is required, the Gym, or parts thereof, may be closed. Any refund given as a result of closure will only be made at the sole discretion of the Director or Manager.

12. HEALTH AND SAFETY

12.1 You must use the main entrance to the Club when entering or leaving the Club.
12.2 Fire exits, which are clearly marked, are there in the interests of safety and you must not interfere with fire doors for any reason.
12.3 You must read the health & safety notices posted outside any equipment, facility rooms including posters in the Club and comply with their recommendations.
12.4 You must comply with any reasonable requests made by the members of staff in relation to matters of health and safety.
